HB 377 (BR 1291) - R. Palumbo, B. Colter

     AN ACT relating to prescription drugs.
     Amend KRS 315.040 to add an exception to the chapter for the activities of a registered or advanced registered nurse who dispenses a prescription drug approved by the Department of Public Health while acting within the scope of employment and as an agent of a local health department or approved by a sponsoring agency as defined in KRS 216.940 while acting within the scope of employment and as an agent of a charitable health care provider.

HB 377 - AMENDMENTS


     HCS - Retain original provisions except specify the exception for dispensing prescriptions for nurses acting with their scope of practice rather than scope of employment.
     HCA (1/Title, R. Palumbo) - Make title amendment.
     HFA (1, R. Damron) - Amend to specify that drugs dispensed by health department or charitable health provider must meet the requirements of KRS Chapter 217 and be prescribed by a practitioner under KRS 217.015; amend KRS 212.230, 212.628, and 212.784 to require local, district, and independent boards of health to adopt a policy on dispensing medication and a policy on parental consent for minors.
     HFA (2, M. Treesh) - Amend to require that no person be compelled to prescribe or dispense any medication or device that is prescribed for the purpose of terminating a pregnancy if the person objects based on moral, religious, or professional grounds.
     HFA (3, M. Treesh) - Amend to require that no person be compelled to prescribe or dispense any medication or device that is prescribed for the purpose of terminating a pregnancy if the person objects based on moral, religious, or professional grounds; and prohibit discrimination against any person who objects or refuses to prescribe or dispense any medication or device that is prescribed to terminate a pregnancy.
     HFA (4, M. Treesh) - Amend to require that no person be compelled to prescribe or dispense any medication or device that is prescribed for the purpose of terminating a pregnancy if the person objects based on moral, religious, or professional grounds.
     HFA (5, M. Treesh) - Amend to require that no person be compelled to prescribe or dispense any medication or device that is prescribed for the purpose of terminating a pregnancy if the person objects based on moral, religious, or professional grounds; prohibit discrimination against any person who objects or refuses to prescribe or dispense any medication or device that is prescribed to terminate a pregnancy.
     HFA (6, R. Palumbo) - Amend to include physician assistants certified under KRS 311.565 among the health care providers who may dispense a prescription drug as an agent of a health department or as a charitable health care provider.
     HFA (7/Title, R. Palumbo) - Make title amendment.
     HFA (8/Title, R. Palumbo) - Make title amendment.
     HFA (9, M. Treesh) - Amend to require that no person shall be compelled to prescribe or dispense any medication or device that is prescribed to cause an abortion if the person states, in writing, an objection to performing, participating in, or cooperating in an abortion based on moral, religious, or professional grounds; and prohibit discrimination against any person who objects or refuses to prescribe or dispense any medication or device prescribed to cause an abortion.
     HFA (10, M. Treesh) - Retain original provisions except require that no person shall be compelled to prescribe or dispense any medication or device that is prescribed to cause an abortion if the person states, in writing, an objection to performing, participating in, or cooperating in an abortion based on moral, religious, or professional grounds; and prohibit discrimination against any person who objects or refuses to prescribe or dispense any medication or device prescribed to cause an abortion.
