HB 41/LM/CI (BR 288) - R. Palumbo, M. Cherry, B. Colter, J. Jenkins

     AN ACT relating to crimes and punishments.
     Create a new section of KRS Chapter 525 to define animal torture, set penalties for animal torture, prescribe allocation of court costs, create exemptions, and distinguish animal torture from animal cruelty; amend KRS 525.130 to distinguish animal torture from animal cruelty and to exempt certain practices from the definition of animal cruelty.

HB 41 - AMENDMENTS


     HCS/LM/CI - Permit, rather than require, the court to order counseling for a defendant convicted of animal torture; create an exception to the animal torture section and the cruelty to animals section for animal and pest control.
     HFA (1, J. Fischer) - Retain original provisions, add defense to charge of animal torture and cruelty to animals in the second degree for bona fide research by a business entity to the exemption for an institution of higher education.
     HFA (2, R. Palumbo) - Amend the exemption to the definition of animal torture relating to activities such as horse racing, training and showing.
     HFA (3, R. Palumbo) - Amend to provide for exemption of business entities engaged in lawful animal research in compliance with federal statutes and regulations related to animal welfare.
     HFA (4, R. Palumbo) - Amend to delete provision relating to seizure of all animals and restrict seizure and forfeiture to animal subject to violation of the law.
