HB 61 (BR 238) - L. Belcher

     AN ACT relating to brokers for the human service transportation delivery program.
     Create a new section of KRS 281.870 to 281.879, relating to the human service transportation delivery program, to define "associated," "business associate," "family member," and "officially terminated"; require a broker, as a condition of his contract with the Transportation Cabinet, to execute a surety bond to protect the subcontractors in the broker's delivery area and other creditors in case the broker terminates his contract with the cabinet; establish requirements associated with the terms and conditions of the bond; prohibit a family member, business associate, or any business or organization associated with a broker from providing surety for the bond; require a person providing surety on a bond to give the cabinet 30 days' written notice if he plans on canceling his surety agreement on the bond; if a broker forfeits a bond requires that subcontractors be the first persons paid with other creditors paid second and any balance to be returned to the person who provided surety on the bond; amend KRS 281.875 to conform; amend KRS 281.879 to establish a penalty for a broker who fails to execute and maintain a surety bond.
