HB 9 (BR 15) - G. Stumbo, P. Bather

     AN ACT proposing to create a new section of the Kentucky Constitution relating to a statewide referendum on container deposit.
     Propose new Section 60a of the Kentucky Constitution to provide a statewide referendum on whether to require a statewide program of deposit for the purchase of beverage containers to be redeemed for deposit; limit application only to this section; provide that the referendum be placed on the ballot at a regular election upon a petition signed by a number of registered voters equal to five percent of the votes cast in the state for slates of candidates for Governor and Lieutenant Governor at the last preceding regular election, and filed with the Secretary of State; prescribe content of petition and provide that General Assembly shall provide the manner in which the petitions shall be circulated, presented, qualified, and published, and the manner in which the referendum shall be submitted to the people, provided that the referendum shall only be submitted if certified as being regular on its face 120 days prior to the election; provide that referendum shall take effect and become a law upon approval by a majority of the votes cast; provide that Governor's veto power shall not apply; provide for codification of the measure; provide that proposed referendum shall not be eligible to be on the ballot for 2 years after its defeat; submit to voters.
