HB 97 (BR 503) - C. Geveden

     AN ACT relating to reorganization.
     Amend KRS 12.020 to create the Office of Public Employee Health Insurance within the Personnel Cabinet; amend KRS 18A.025 to remove Health Insurance and the Flexible Benefit Plan from the Division of Employee Benefits within the Department for Employee Relations and place them under the jurisdiction of the newly created Office of Public Employee Health Insurance; confirm Executive Order 2000-1316.

HB 97 - AMENDMENTS


     HCS - Retain original provisions of the bill except delete the reference of Kentucky Kare being within the Office of the Secretary of the Personnel Cabinet.
     HFA (1/Title, J. Vincent) - Make title amendment.
     HFA (2, J. Vincent) - Create a new section of KRS Chapter 18A to require the Office of Public Employee Health Insurance to promulgate an administrative regulation that provides if there is only one health plan available in the county, the office shall rebid every 30 days until at least two (2) plans are available.
     HFA (3/Title, J. Vincent) - Make title amendment.
     HFA (4, J. Vincent) - Retain original provisions and add a new section to amend KRS 18A.225 to permit the Personnel Cabinet to declare an emergency when only 1 health plan is available in a county and the health insurance company fails to maintain at least 60% of its specialty physicians after the open enrollment period, require the cabinet to notify the Governor, Legislative Research Commission, and the secretary of the Finance and Administration Cabinet and permit the Personnel Cabinet to negotiate and contract with other providers without meeting the requirements of KRS Chapter 45A; specify this provision applies to calendar year 2001 only.
     HFA (5/Title, J. Vincent) - Make title amendment.
     HFA (6, J. Vincent) - Retain original provisions and add a new section to amend KRS 18A.225 to permit the Finance and Administration Cabinet to declare an emergency when only 1 health plan is available in a county and the health insurance company fails to maintain at least 65% of its specialty physicians after the open enrollment period; require the cabinet to notify the Governor, Legislative Research Commission, and the secretary of the Personnel Cabinet and permit the cabinet to negotiate and contract with other providers without meeting the requirements of KRS Chapter 45A; specify this provision applies to calendar year 2001 only; EMERGENCY.
