AN ACT relating to government contracts.
Create new sections and amend several sections of KRS Chapter 45A to provide for legislative intent; exempt memoranda of agreement (MOA's) between state agencies and universities or colleges from routine review, but require filing of the agreement with the Government Contract Review Committee not more than 30 days after the effective date, require routine review if filed more than 30 days after the effective date, and provide for ongoing jurisdiction of and agency participation; allow the committee to receive testimony under oath and establish procedures; limit noncompetitively negotiated contracts to not more than two years within the biennium; delete a conflicting provision of the statutes relating to competitive bids for personal service contracts; require request for proposals for noncompetitively negotiated contract renewals or renegotiations; establish the definition of emergency condition; rename the Kentucky Distinguished Educators provision; clarify the exemption related to federal or state law; remove the provision exempting agreements between state agencies and state universities or colleges from the definition of MOA; require request for proposals for personal service contracts over $10,000; specify that personal service contracts and MOA's shall not be paid until after completion of the review process by the committee; require a decision by the agency head and the secretary of the Finance and Administration Cabinet to override committee disapproval; specify that the secretary of the Finance and Administration Cabinet and (in certain circumstances) the agency head must make a determination that there is a governmental emergency and require communication of those reasons to the committee; and delete requirement for annual reports.
