SB 114 (BR 1014) - R. Stivers

     AN ACT relating to the carrying of concealed deadly weapons.
     Amend KRS 527.020, relating to carrying concealed deadly weapons, to permit an elected Commonwealth's or county attorney to carry a concealed deadly weapon at all times and at any location within the state; permit an assistant Commonwealth's attorney or assistant county attorney to do so with the written permission of the Commonwealth's or county attorney, as appropriate.

SB 114 - AMENDMENTS


     SCS - Delete the provisions of the bill; amend KRS 237.110 to permit a judge, Commonwealth's attorney, assistant Commonwealth's attorney, county attorney, or assistant county attorney who holds a concealed carry license to carry a concealed deadly weapon at all times and at all locations within the Commonwealth.
     HFA (1, C. Hoffman) - Retain original provisions, permit retired, senior status, and former justices and judges of the Court of Justice as well as active justices and judges to carry concealed weapons.
     HFA (2, K. Stein) - Amend to require firing of handgun at a moving target rather than a stationary target for qualification to carry a concealed weapon.
     HFA (3/P, K. Stein) - Retain original provisions; add requirement to present motor vehicle or motorcycle operator's license or doctor's statement of visual acuity of not less than 20/60 in at least one eye corrected by a single lens system.
     HFA (4, J. Turner) - Retain original provisions, add provisions permitting judicially recognized officers of the court to carry concealed weapons in court if they have a license, require an FBI check for permit holders, and permit possession of ammunition where possession of a deadly weapon is permitted.
     HFA (5/P, J. Gray) - Add new Section 2 amending KRS 527.020 to permit out-of-state peace officers and elected sheriffs to carry concealed deadly weapons in Kentucky on or off duty if Kentucky peace officers and elected sheriffs are permitted by law to do so in their state.
     HFA (6, T. Riner) - Create a new section of KRS Chapter 6 to provide that roll call votes of the Kentucky House of Representatives and Senate shall not be considered to be concealed deadly weapons, and the Legislative Research Commission shall post a record of all such votes on its web site.
     HFA (7, J. Gray) - Amend KRS 527.020, relating to carrying concealed deadly weapons, to permit sheriffs and deputies, jailers and deputies, coroners and deputies, state and public university safety and security officers, school security officers, airport safety and security officers.
     HFA (8/P, C. Geveden) - Attach the provisions of HB 50.
     HFA (9/Title, C. Geveden) - Make title amendment.
     HFA (10, T. Riner) - Create a new section of KRS Chapter 6 to provide that roll call votes are not considered to be concealed deadly weapons and the LRC shall post roll call votes on their web site.
     HFA (11/P, J. Adams) - Attach provisions of SB 57 GA.
     CCR - Conference Committee agreed to disagree and requested Free Conference Committee be appointed.
     FCCR (Majority Report) - Retain the provisions of HFA 1 amending KRS 237.110 relating to permitting active, retired, or former justices or judges to carry concealed firearms at all times and all locations within the state if they have a concealed deadly weapon license. Retain provisions of HFA 4 amending KRS 237.110 to permit concealed deadly weapon license holders to possess ammunition as well as firearms in locations where they are permitted to carry firearms with a concealed deadly weapon license; delete FBI instant record check for concealed deadly weapon license applicants; and delete provision permitting "judicially recognized officers of the court" who hold a concealed deadly weapon license to carry concealed deadly weapons in a courtroom. Retain provision of HFA 5 amending KRS 527.020 permitting a full-time out-of-state peace officer to carry a concealed deadly weapon in Kentucky when on duty if the officer's home state permits Kentucky full-time peace officers to carry concealed deadly weapons while on duty; delete provision permitting off duty full-time out-of-state peace officer to carry concealed deadly weapons in Kentucky when off duty. Retain provisions of HFA 7 amending KRS 527.020 permitting full-time certified police officers, alcoholic beverage control officers, sheriffs, deputy sheriffs, jailers, deputy jailers, local government corrections director, and local government corrections employees to carry concealed deadly weapons at all times and all locations within the state when expressly permitted to do so by the government or elected official employing them; delete similar authorization for university safety and security officers, local school safety and security officers, airport safety and security officers, Department of Insurance fraud investigations, coroners, and deputy coroners to do likewise. Combine all retained provisions into a single amendment.
