SB 153 (BR 1362) - A. Kerr

     AN ACT relating to testing for the human immunodeficiency virus.
     Create a new section of KRS Chapter 214 to permit the Department for Public Health to develop and implement a training program to reach all licensed and certified health care providers who provide prenatal care or HIV counseling for pregnant women or newborns; set forth elements for training; permit the department to develop materials relating to HIV for distribution to pregnant women and permit publication on the department's web site; amend KRS 214.155 to require testing of the newborn for HIV if the mother was not tested during pregnancy; amend KRS 214.160 to require a physician treating a pregnant woman to test, subject to informed consent, the woman for HIV; require health care provider who conducts the HIV test to first inform the woman about benefits of testing and confidentiality and make referrals for counseling; require, at time of admission for delivery of the baby, that the health care provider inform the pregnant woman of the benefits of HIV testing if there is no documentation in her medical record that she has previously been informed, and urge testing; establish short title as The Baby AIDS Act.

SB 153 - AMENDMENTS


     SCS - Delete original provisions; provide for General Assembly findings and declarations concerning the need for testing of pregnant women for HIV and the likelihood of reducing transmission of HIV from the pregnant woman to the fetus or newborn if knowledge of HIV is known prior to birth; create a new section of KRS Chapter 214 to encourage the Kentucky Medical Association to work closely with the Cabinet for Health Services to determine the percentage of pregnant women in Kentucky who are not offered testing for HIV and submit a report of the findings to the Interim Joint Committee on Health and Welfare prior to September 1, 2001.
