SB 155/LM (BR 1418) - R. Jones II

     AN ACT relating to motor carrier safety.
     Create a new section of KRS 281, regarding motor carrier safety, to define the terms "lights" and "reflectors"; require operators of commercial vehicles to have all lights and reflectors required by federal regulation to be present, operable, and unobstructed by dirt or debris; direct law enforcement and the Transportation Cabinet to aggressively enforce violations of this section; amend KRS 281.990 to set penalties for violation at $250 for each offense; allow dismissal of a citation for inoperable lights or missing reflectors if the offender presents proof to the county attorney, within thirty days of the citation, that the defect has been corrected; prohibit dismissal of citation or reduction of fine if citation was for obstructed lights or reflectors.

SB 155 - AMENDMENTS


     SFA (1, R. Jones II) - Amend the penalty provisions to delete paragraph (c) of subsection (5) of Section 2 in its entirety and replace it with provisions that a person shall not be issued a citation if the atmospheric conditions all motorists were subjected to at the time the person is stopped by a law enforcement officer reasonably limit the ability of a person to keep the vehicle's lights or reflectors from being obscured by dirt, mud, or debris.
