SB 96 (BR 1010) - D. Mongiardo
AN ACT relating to medical records for health care providers participating in Medicaid.
Create a new section of KRS 205.510 to 205.630 to permit a Medicaid-participating health care provider to maintain in an electronic medical record database the medical record for each public medical assistance patient treated by the health care provider, and permit the Cabinet for Health Services to view a written copy of the record at the expense of the provider within 10 days after submitting a written request.
SB 96 - AMENDMENTS
SCS - Retain original provisions, except delete requirement for written request of medical record to be supplied within 10 days; require provider who maintains database to notify department and certify as to confidentiality and patient privacy; institute best practices to prevent access to database, prevent computer hacking, and to assure security; clarify that medical records shall not be transmitted electronically to the department.
