SB 98 (BR 491) - D. Mongiardo, J. Pendleton

     AN ACT relating to health insurance.
     Amend KRS 304.17A-708 to decrease from 24 months to 180 days the time period in which a provider may request an insurer to correct a payment error; decrease from 24 months to 180 days the period of time within which a health insurer may seek reimbursement from a provider for overpayment of claims; amend KRS 304.17A-712 to give the provider 30 days to respond to a request for reimbursement from a health insurer; permit the provider to choose to reimburse an insurer for overpayment by refunding the insurer or by authorizing the insurer to recoup the overpayment; allow recoupment if the provider does not respond within 30 days.

SB 98 - AMENDMENTS


     SCS - Retain original provisions; change 180 days to 18 months; permit the provider to contest the insurer's claim for reimbursement for overpayment of a claim; amend KRS 304.17A-710 to require an insurer to provide the provider with a written copy of the insurer's complete fee schedule when the insurer and provider enter into a contract; require that a contracted provider receive notice of changes to the fee schedule; amend KRS 304.17A-730 to require an insurer who must pay interest on a late claim to designate the claim on which the interest is being paid; provide that the designation must include the name of the patient and the date of the service.
