HB 232 (BR 1086) - R. Damron
AN ACT relating to the lottery.
Create a new section of KRS 154A to require that lottery vending machines be placed in the cashier's direct line of sight except where the machines are located in factories or in bars or taverns where persons 18 years of age are not permitted access; amend KRS 154A.990 to provide for a civil fine of between $100 and $500 dollars for lottery retailers in violation.
HB 232 - AMENDMENTS
HCS - Insert package liquor stores as an exception for vending lottery machines in sight of retailer; delete unobstructed line as condition of being in sight of retailer; change “cashier” to “employees” of retailer; delete penalty provisions of a civil fine for violation; insert new penalty; include notification by the corporation that the retailer has thirty days to correct violation, and if after thirty days the violation is not corrected, then the vending machine will be removed from the retailer.
SCS - Retain original provisions except exempt blind persons who operate vending machines as part of a program established by federal or state law from the requirement that a lottery retailer locate any vending machine from which lottery tickets are dispensed in the sight of employees of the lottery retailer.
