HB 26/CI (BR 316) - J. Coleman, Ro. Adams, I. Branham
AN ACT relating to controlled substances.
Amend KRS 218A.180 to require any prescription for oxycodone hydrochloride or morphine sulfate, including but not limited to Oxycontin or MS Contin, to have the diagnosis written on the prescription and signed by the practitioner ordering the medication; and limit the prescribing of oxycodone hydrochloride or morphine sulfate to diagnoses included on the manufacturer's labeling or approved by the Federal Food and Drug Administration, including the control of moderate to severe pain.
HB 26 - AMENDMENTS
SCS - Delete original provisions; amend KRS 218A.202 to authorize the Cabinet for Health Services to provide data from the electronic monitoring system for scheduled drugs to state, federal, or municipal officers who are engaged in a bona fide specific investigation involving a violation where there is an identifiable trend of illegal drug diversion in a geographic area; require the Governor's Office for Technology, in consultation with the Cabinet for Health Services, to apply for federal funds for a pilot project implementing a real-time electronic system to monitor prescriptions for scheduled drugs in two rural counties; apply the data collection, disclosure, access, and penalties provisions to the pilot project; EMERGENCY.

SFA (4, J. Denton) - Create a new section of KRS 205.510 to 205.645 to require adult day health care programs to provide services only during the posted hours of operation.

SFA (8, J. Denton) - Delete the requirement that the Cabinet for Health Services provide data from the electronic monitoring system for scheduled drugs to state, federal, or municipal officers who are engaged in a bona fide specific investigation involving a violation where there is an identifiable trend of illegal drug diversion in a geographic area; require all pharmacists dispensing controlled substances in the state to be licensed under KRS Chapter 315; require all controlled substances dispensed to an address to be dispensed under the control of a pharmacist licensed in Kentucky, except in an out-of-state pharmacy where only the pharmacist in charge is required to be licensed in Kentucky; require that pharmacists or their employees or agents obtain a signature of the person taking possession of a controlled substance, require Schedule II drugs to be delivered by certified mail or other delivery system requiring a signature; require pharmacies to retain records of signatures for two (2) years; provide for exemptions for substances received by an agent of a health care facility; and exempt these provisions from the emergency clause.
