HB 260 (BR 1512) - Ji. Lee, J. Bruce, B. Buckingham, S. Riggs, B. Yonts

     AN ACT relating to motor vehicles.
     Amend KRS 190.033, which requires a surety bond or insurance policy be on file prior to issuance of a motor vehicle dealer's license, motor vehicle auction dealer's license or wholesaler's license, to provide that the insurance coverage mandated by this section is in excess of and secondary to the insurance coverage of a customer or other person for their own negligence; and, amend KRS 304.20-065, which requires that collision coverage on every motor vehicle licensed in the state cover the insured individual while operating a loaned motor vehicle while the insured's vehicle is being repaired or serviced, to extend the requirement of coverage on a loaned motor vehicle during repair or servicing to include liability coverage.

HB 260 - AMENDMENTS


     HCA (1/Title, S. Riggs) - Make title amendment.

     HFA (1, J. Lee) - Clarify that the motor vehicle dealer's coverage is secondary to the coverage of the person operating a motor vehicle which is loaned as a replacement vehicle while the person's vehicle is out of use because of breakdown, repair, or servicing.

     HFA (2, J. Lee) - Clarify that the motor vehicle dealer's coverage is secondary to the coverage of the person operating a motor vehicle which is loaned as a replacement vehicle while the operator's vehicle is out of use because of breakdown, repair, or servicing; provide that motor vehicle insurance policies with bodily injury coverage extend coverage to cover the insured individual while operating a loaned vehicle while the operator's vehicle is out of use because of breakdown, repair, or servicing.

     HFA (3, J. Lee) - Clarify that if a customer's or other person's vehicle is out of use because of breakdown, repair, or servicing and a motor vehicle is loaned, the motor vehicle dealer's coverage is excess coverage to the collision, bodily injury, and property damage liability coverage of the customer or other person's own insurance.
