HB 283 (BR 1537) - S. Nunn

     AN ACT relating to medical assistance.
     Amend KRS 205.6312 to require the Cabinet for Health Services to institute nominal copayments for Medicaid services provided to recipients over the age of 18, including prescription drugs and over-the counter drugs; establish exemptions; require copayments to apply to services provided by prepaid health plan programs; and authorize the cabinet to promulgate administrative regulations.

HB 283 - AMENDMENTS


     HFA (1, S. Nunn) - Retain original provisions; limit the copayment amount for prescription and over-the-counter drugs covered under the Medicaid program to one dollar for recipients who are not excluded from copayments.

     SCS - Retain original provisions except delete language exempting family planning services and supplies furnished to individuals of childbearing age from copayment; and make technical correction.

     SFA (1, T. Buford) - Retain original provisions except add that a pharmacist or pharmacy that does not receive a copayment shall be entitled to a tax credit; create a new section of KRS Chapter 141 to specify that the pharmacy or pharmacist receive a nonrefundable tax credit in the amount equal to the amount of copayment charged but not collected, permit the tax credit to pass through if the taxpayer is a pass-through entity, and require the Revenue Cabinet to determine the method of reporting the tax credit; amend KRS 141.020 and 141.040 to conform.
