HB 296 (BR 196) - B. Colter, W. Scott

     AN ACT relating to student loans.
     Amend various sections of the Kentucky Revised Statutes to require as a prerequisite for initial issuance and renewal of a professional license that an applicant who has received financial aid is meeting the repayment obligation under any program provided in KRS Chapter 164 or 164A administered by the Kentucky Higher Education Assistance Authority, or that the authority has granted a waiver of the obligation for cause and to require that a default of the obligation shall render the applicant ineligible for licensure until the obligation is satisfied; amend KRS 164.748 to direct the authority to share information on the status of repayment with a financial aid recipient and a professional and regulatory board; the following professions are included: attorneys, KRS 21A.160; alcohol and drug counselors, KRS 309.083 and 309.085; professional art therapists, KRS 309.133 and 309.1335; podiatrists, KRS 311.420 and 311.450; dietitians, KRS 310.021; nutritionists, KRS 310.031 and 310.050; osteopaths, KRS 311.565; chiropractors, KRS 312.085 and 312.175; dentists, KRS 313.040 and 313.080; dental hygienists, KRS 313.290 and 313.305; registered nurses, KRS 314.041; advanced registered nurse practitioners, KRS 314.042; licensed practical nurses, KRS 314.051; renewal of license to practice nursing, KRS 314.071; pharmacists, KRS 315.050 and 315.110; embalmers and funeral directors, KRS 316.030, 316.130, and 316.131; psychologists, KRS 319.032; occupational therapists or occupational therapy assistants, KRS 319A.110 and 319A.160; optometrists, KRS 320.250 and 320.280; veterinarians, KRS 321.193, 321.211; and 321.221; veterinary technologists, KRS 321.441; professional engineers, KRS 322.050; professional geologists, KRS 322A.040 and 322A.060; architects, KRS 323.050 and 323.110; certified public accountants, KRS 325.261 and 325.330; physical therapists, KRS 327.050; speech-language pathologists or audiologists, KRS 334A.050 and 334A.170; licensed social workers, KRS 335.090; certified social workers, KRS 335.080; licensed clinical social workers, KRS 335.100; renewal of social worker licenses, KRS 335.130; marriage and family therapists, KRS 335.330; and professional counselors, KRS 335.525 and 335.535.

HB 296 - AMENDMENTS


     HCS - Create new section in KRS 164.740 to 164.785 to require state agencies that issue professional or occupational licenses, certification or registration not to issue a new license or renew a license for those applicants who have defaulted on the repayment obligations to financial aid programs administered by the Kentucky Higher Education Assistance Authority in KRS Chapters 164 and 164A; define “licensing agency”; require the authority to declare default; allow licensing agency to require applicant for licensing to certify that he or she is not in default; state conditions under which licensing agency can license with verification of authority; require authority and licensing agency to enter into agreement on exchanging information on borrowers; require notice of repayment and list consequences and time frames for responding and negotiating repayment obligation; require authority to notify licensing agency when satisfactory payment plan has been negotiated; and amend KRS 154A.060 and KRS Chapter 164 to require that the Kentucky Lottery Corporation and the authority develop a system that provides names of borrowers in default so that prize winnings can be claimed, transferred to the authority and credited to the account of the borrower.
