HB 316/LM (BR 1023) - T. Kerr

     AN ACT relating to titling of motor vehicles.
     Amend KRS 186A.115, regarding inspection of vehicles brought into the state, to allow a Kentucky resident who will be out of the state for 30 consecutive days following the purchase of a vehicle to be titled in Kentucky to have the vehicle inspected by a law enforcement or vehicle inspection agency in that state; identify information to which the inspector must attest; provide that the Transportation Cabinet publish a suitable affidavit on their internet web page; require that the person using an inspection program in another state abide by all the requirements of that state, including payment of fees; require that a vehicle inspected in this manner be titled by the Transportation Cabinet rather than the county clerks.

HB 316 - AMENDMENTS


     HCS - Add a new paragraph (d) to subsection (1) to require a car inspected in one county in Kentucky and the fee paid for the inspection be honored by the certified inspector, sheriff, and county clerk in all other counties in the state; amend paragraph (e) of subsection (1) to provide that application for registration and payment of usage tax shall be made to the county clerk of the county in which the person resides and not made to the Transportation Cabinet.

     HFA (1, T. Kerr) - Provide that a KY resident out of state for at least 30 days, but not longer than 9 months, may have a vehicle purchased out of state inspected while in the other state and have that inspection recognized in KY; delete requirement that resident must be out of state for business or school activities.

     HFA (2, J. Lee) - Provide that a KY resident out of state for at least 30 days, but not longer than 6 months, may have a vehicle purchased out of state inspected while in the other state and have that inspection recognized in KY; delete requirement that resident must be out of state for business or school activities.

     SCS/LM - Retain the provisions of the GA copy of HB 316 and add a new Section 2 amending KRS 186A.120 to allow dealers outside the buyer's home county to process title applications with the county clerk in the dealer's county, but split the usage tax money retained by the clerk under KRS 138.460(3) equally between the clerks in the dealer's county and the buyer's county.

     SFA (1, D. Seum) - Add new Sections 3, 4, and 5 to require the Transportation Cabinet to report annually to the LRC on the Motorcycle Safety Education Fund; expand the information that must be included in the report; prohibit the Transportation Cabinet from using any money from the Motorcycle Safety Education Fund for administrative costs; require the Transportation Cabinet to report monthly to the Appropriations and Revenue committee regarding the Motorcycle Safety Education Fund; amend KRS 189.285 to exclude three wheel electric vehicles from the definition of a motorcycle.

     SFA (2/Title, D. Seum) - Amend the title to read as follows: "AN ACT relating to transportation."

     SFA (3, D. Kelly) - Retain the provisions of the Senate Committee Substitute to HB 316 and attach the provisions of Sections 1 to 4 of the Senate Committee Substitute to HB 12.
