     AN ACT relating to agriculture water quality.
     Create a new section of KRS Chapter 224 relating to the Agriculture Water Quality Act to grant confidentiality to documents submitted to local conservation offices and the Division of Water for purposes of the Act; direct that "bad actors" under the Act shall lose the confidentiality; allow a limited disclosure of statistical data that may arise from the documents.

HB 367 - AMENDMENTS


     HCS - Retain original provisions with the following changes: provide confidentiality to documents submitted to a state agency rather than to the Division of Water; limit the documents that are granted confidentiality by excluding applications for financial assistance from the soil erosion and water quality cost share program; allow a court to review documents claimed as confidential to determine if the confidentiality is lost because of evidence of noncompliance; clarify that agency data relating to water quality is not confidential.

     HFA (1, J. Barrows) - Expand the exclusion from confidentiality plans written for farms in regions designated as water priority protection regions and to certain actions of the Kentucky Water Quality Authority.

     HFA (2, J. Barrows) - Direct that the confidentiality granted by the Act shall not preclude disclosure of an agriculture operation's agriculture water quality plan to the Agriculture Water Quality Authority.
