HB 375/FN (BR 1047) - P. Bather, S. Nunn
AN ACT relating to an electronic health network and declaring an emergency.
Create new sections of KRS Chapter 11 to declare findings of the General Assembly related to electronic health information and define terms; amend KRS 11.550 to reorganize the Telehealth Board as the Kentucky e-Health and Telehealth Board; attach the board to the Governor's Office of Technology, the Office of the New Economy, and the Cabinet for Health Services; establish the membership of the board; establish the responsibilities of the board; require the board to establish certain committees and an advisory group to ensure input into the evaluation and choice of any model selected for implementation; require the board to conduct a feasibility study, including a business plan of various models; authorize the board to implement a model if deemed feasible; require any model selected to comply with the Federal Health Insurance Portability and Accountability Act; require the board to submit the results of the feasibility study and a description of the model selected to the Legislative Research Commission prior to November 1, 2002; require the board to seek any necessary state funding to implement the selected model through the state appropriations process; require the board to oversee the implementation of any feasible model selected by the board; require the board to oversee the development of the network of providers and payors and adopt standards for computer systems communicating with the central part of the network; authorize the board to promulgate administrative regulations; require the board to assume the responsibilities of the Telehealth Board under KRS 11.550; require an annual report to the Legislative Research Commission, Interim Joint Committee on Health and Welfare, and the Interim Joint Committee on Banking and Insurance; authorize the board to seek revenue bonds through the Economic Development Cabinet; establish a "Ke-HN and Telehealth fund"; create a new section of KRS Chapter 154 to authorize the Kentucky Economic Development Finance Authority to give high priority to projects related to the Kentucky e-Health Network in its approval of funding of projects; permit companies that develop or manufacture software related to the Kentucky e-Health Network to receive incentives under Subchapters 22, 23, 24, 26, and 28 of KRS Chapter 154 if the company meets all the eligibility criteria; amend KRS 164.6015, 164.6021, 164.6029, 164.6037, 154.12-270, and 154.12-274 to encourage the research, development, and funding of an electronic health network; amend KRS 154.12-278 to expand the duties of the Office of the Commissioner for the New Economy to include promoting the development and securing funds for the Kentucky e-Health Network; create a new section of KRS 205.510 to 205.630 to require the Department for Medicaid Services to apply for federal funding to develop the infrastructure that integrates existing Medicaid administrative transactions with the Kentucky e-Health Network; authorize the cabinet to collaborate with the Cabinet for Families and Children to include eligibility for other public assistance programs and food stamps into the network; retain current members of the Telehealth Board as members of the Kentucky e-Health and Telehealth Board; transfer telehealth funds to the new board; EMERGENCY.
HB 375 - AMENDMENTS
HCA (1, P. Bather) - Retain original provisions; clarify that federal and private funds would be used to study the feasibility of implementing an electronic health network; require the feasibility study to include business cases instead of business plans; require the feasibility study and a description of the model chosen to be submitted to the Legislative Research Commission immediately upon its completion instead of prior to November 1, 2002; require the board to report to the secretary of the Cabinet for Health Services and the Commissioner of the Office for the New Economy annually on the development of the Kentucky e-Health Network and its impact on quality and cost of health care; permit the Governor's Office for Technology to apply for the issuance of revenue bonds for the Kentucky e-Health Network, upon request of the board; delete the attachment of the board to the Cabinet for Health Services and the Office for the New Economy, but retain the attachment to the Governor's Office for Technology; and make technical corrections.
HCA (2, P. Bather) - Retain original provisions; delete aggregate data for clinical research and utilization of health services from the types of activities that the Kentucky e-Health Network is envisioned to support; add one (1) hospital representative to the Privacy and Security of Protected Health Information Committee of the Kentucky e-Health and Telehealth Board; and make technical corrections to conform.
HFA (1, R. Damron) - Restrict the board to conducting a feasibility study of an electronic health network to be completed by November 1, 2002; delete authorization of the board to implement an electronic health network; delete authorization of the Economic Development Cabinet, upon request of the board, to apply to the State Property and Buildings Commission for the issuance of revenue bonds to finance the costs of the design, development, and maintenance of the electronic health network; delete directing the Kentucky Economic Development Finance Authority to give high priority to projects related to the electronic health network; delete authorization to give tax credits, low interest loans, and grants to companies that develop or manufacture software for the development of the electronic health network; delete the requirement that the Department for Medicaid Services submit a letter of intent to develop the comprehensive Medicaid management system to the Federal Centers for Medicare and Medicaid Services no later than August 30, 2002; make technical changes.
