AN ACT relating to real property.
Amend KRS 411.190 and 413.010 to prohibit recreational users from bringing an action to assert prescriptive easement, right-of-way, or adverse possession.
HB 387 - AMENDMENTS
HFA (1, F. Nesler) - Clarify that actions to recover real property may not be brought by anyone whose claim is based on use solely for recreational purposes.
SFA (1, T. Buford) - Add a new Section 3 to the GA Copy of HB 387 to authorize a property owner to construct a landing strip for private use of two aircraft if the person lives in a county with a population of 30,000 or greater and the person owns at least 1,500 contiguous acres; require the landing strip to meet FAA requirements; prohibit local governments from regulating private landing strips.
SFA (2, T. Buford) - Delete the provisions of the GA Copy of HB 387 in its entirety and insert in lieu thereof a new section to authorize a property owner to construct a landing strip for private use of two aircraft if the person lives in a county with a population of 30,000 or greater and the person owns at least 1,500 contiguous acres; require the landing strip to meet FAA requirements; prohibit local governments from regulating private landing strips.
