     AN ACT relating to surface mining.
     Create a new section of KRS Chapter 351 to provide that a mining permit is not required of a landowner if coal extraction is related to construction, under 5000 tons, and the coal or proceeds of a coal sale are donated to charitable, governmental, or educational organizations; require that technical assistance be provided to the landowner by the Department for Surface Mining and Reclamation; amend KRS 350.010 to conform.

HB 405 - AMENDMENTS


     HCS/FN - Retain original language adding new section to Chapter 351 to provide that a mining permit is not required of private landowner if coal extraction is related to construction, is under 5000 tons, and coal or proceeds of coal sale is donated to charity, governmental, or educational organizations and that technical assistance be provided to landowner by the Department for Surface Mining and Reclamation; make technical changes and add that the technical assistance be related to federal and state law; delete a conforming amendment to KRS 350.010; add non-codified section declaring an emergency.

     HCA (1/Title, H. Moberly) - Make title amendment.

     SCA (1, E. Harris) - Require the landowner, in order to get the exemption, to notify the cabinet at the time that coal is first encountered and prior to removal, and require the cabinet to determine whether the project is eligible for the exemption; allow the cabinet to require implementation of such best management practices as are necessary to ensure compliance with stormwater discharge limits; delete the cabinet's optional advice and technical assistance provisions.
