HB 455/FN (BR 1571) - S. Brinkman

     AN ACT relating individuals with autism.
     Create a new section of KRS Chapter 205 to define autism and require Department for Medicaid Services to apply for a Medicaid waiver for services to children with autism; specify services to be included in the waiver application and provider requirements; require report from cabinet on services provided; amend KRS Chapters 200, 347, and 387 to include service to individuals with autism.

HB 455 - AMENDMENTS


     HCS (1) - Retain original provision except define "pervasive developmental disorders" rather than "autism" in the same terms as defined in the Diagnostic and Statistical Manual of Mental Disorders and include 5 diagnostic subcategories; require application for a Medicaid waiver for services to individuals who have a diagnosis of pervasive developmental disorder; require funding for the waiver from FY 2001-2002 expenditures in the Impact Plus program; permit the Cabinet for Health Services to specify a maximum number of individuals to be served and a maximum dollar amount per individual served; amend KRS 200.654 to specify that early intervention services include services to infants and toddlers with pervasive developmental disorders and services provided include social skills development and behavioral therapies; amend KRS 347.020 to include individuals with a pervasive developmental disorder and include behavioral therapies as part of services to persons with a developmental disability.

     HCS (2/FN) - Limit number of children served under the waiver program to ensure budget neutrality; specify that social skill developmental and behavioral therapy services are available to PDD children.

     HCA (1/Title, T. Burch) - Make title amendment.

     HFA (1, S. Brinkman) - Retain original provisions except replace "capitate" with "cap."

     SCS/FN - Retain original provisions and amend KRS 205.6317 to specify that funds for the Supports for Community Living Waiver Program shall be used only for direct services to individuals and specify that unexpended funds shall not lapse but be carried forward to the next fiscal years and used for the same purpose.
