HB 467/FN (BR 1744) - R. Palumbo, M. Marzian

     AN ACT relating to dental hygienists.
     Amend KRS 313.310 to expand a licensed dental hygienist's scope of practice and to define criteria to permit some services a dental hygienist may provide without the physical presence of a supervising dentist; define services allowed without supervision for not more than 15 days; define training, experience, and recertification requirements; require that administrative regulations be promulgated to determine procedures a dental hygienist shall not perform without supervision including treating a patient the dentist has not examined within the previous 7 months and receiving that patient's written consent acknowledging dentist's absence during treatment; establish entities eligible to be supervising dentists for licensed dental hygienists; create new section of KRS 313.259 to 313.350 to define training, certification, and recertification requirements for licensed dental hygienists who may administer anesthesia, including nitrous oxide, to patients under supervision of licensed dentist; expand responsibilities of board to promulgate administrative regulations to define certification requirements, duties, training, and standards of practice for certified dental assistants and expanded duties dental assistants; permit the board to approve instructors and courses of study for certifying dental assistants and authorize the instructor to issue certificates under the board's direction; define the duties of dental assistants to include coronal polishing; limit the number of licensed dental hygienists and certified assistants who may be supervised by a licensed dentist at any one time; and define treatments that shall not be allowed to be performed by certified dental assistants and expanded duties dental assistants.

HB 467 - AMENDMENTS


     HCS/FN - Retain original provisions, except provide for dental assistant to complete a dental assisting course at an institution of dental education accredited by the Council on Dental Accreditation as one of the certification requirements; delete the provisions relating to an expanded functions dental assistant; delete the provision limiting a practicing dentist from having under his supervision more than 2 full-time dental assistants or expanded functions dental assistant; delete the provision requiring the dental assistant to have a certificate ensuring that training had included completion of designated courses; and make technical changes.

     SFA (1, D. Seum) - Create new sections of KRS Chapter 313 to require licensing of persons engaging in the practice of denturitry; define the practice; prohibit one from engaging in the practice if he or she is not licensed and has not registered with the Board of Dentistry or does not meet minimum competencies; require board to establish licensing process within 6 months, otherwise the Kentucky Denturists Association will provide a list of names of qualified denturists to board, which shall then issue licenses, rather than allow for Association to issue licenses; establish fines and jail time for persons practicing denturitry without a license; permit board to institute legal action to obtain injunction against persons practicing without a license; provide for reciprocal licensing; provide for grandfather clause; permit a person who has practiced as a denturist for 2 years to be licensed upon submitting 3 affidavits from former patients, 3 affidavits from persons who have received denturitry services within last year, and an affidavit showing proof of membership in the Association for at least 2 years; require board to institute disciplinary action against persons practicing without a license; and require board to issue regulations within 6 months to implement Act.
