HB 470 (BR 1654) - A. Arnold, D. Pasley
AN ACT relating to functions of the Kentucky Department of Agriculture.
Amend various sections of KRS 246, relating to the functions of the Kentucky Department of Agriculture, to drop references to mines, factories, industry, and other entities to slightly narrow the scope of the department's reporting and coverage; give jurisdiction to the department rather than the Board of Agriculture for inspections and entering on premises to perform work of the department; and make technical changes; repeal various sections of KRS 246 to remove some reporting requirements relative to the state's agricultural and other resources, and terminate the department's program for regulating spray painting operations.
HB 470 - AMENDMENTS
HCA (1, R. Thomas) - Remove language that refers to the state entomologist having duties of the state apiarist.
SCS - Retain original provisions of bill, except amend Section 1, subsection 8 to add privately owned, raised, and confined deer and elk to the definition of "livestock".
SFA (1, R. Stivers) - Restrict the importation of cervids that have not met certain protocols relating to Chronic Wasting Disease, that have come from cervid herds that have had cervids introduced into the herd within the past 60 months, or that have come from states that have had any confirmed cases of Chronic Wasting Disease; provide penalties for violating the restrictions.
SFA (2, R. Stivers) - Retain original provisions of bill, except amend Section 1, subsection 8, to delete new language adding confined deer and elk to the definition of "livestock".
SFA (3, D. Mongiardo) - Prohibit persons from bringing cervids into or through Kentucky from states that have not been certified as disease-free from Chronic Wasting Disease, brucellosis, or tuberculosis for a minimum of five years.
SFA (4, V. McGaha) - Create new sections of KRS Chapter 150 and KRS Chapter 246 to require the Department of Agriculture in cooperation with the Department of Fish and Wildlife to promulgate administrative regulations pertaining to health requirements, eradication of diseases, and identification of privately-owned and farm-raised cervids; permit the Department of Fish and Wildlife to promulgate administrative regulations in cooperation with the Department of Agriculture relating to the importation and holding of cervids; amend KRS 246.010 to include in the definition of agriculture deer and elk that are privately-owned and raised in confined areas for breeding stock, food, fiber and other products; amend KRS 257.010 to include in the definition of livestock deer and elk that are privately-owned and raised in confined areas for breeding stock, food, fiber and other products; renumber sections to conform; and declare an EMERGENCY.
