HB 48 (BR 370) - S. Riggs

     AN ACT relating to the issuance of county debt
     Amend KRS 66.310 relating to hearing procedure and provide that state local debt officer to provide notice of hearing under KRS Chapter 424 on proposed bond issue by county, allow presentation of evidence, require finding of facts, and preparation of decision by state local debt officer, set out criteria for denial of bond issues, provide for appeal of decision of state local debt officer granting bond issue to be in the circuit court of the county seeking to issue bonds, state local debt officer not to be named a party to appeal, provide appeal of decision denying bond issue to remain in Franklin Circuit Court, state local debt officer required to be a party, appeal shall be on the record, amend KRS 11.400 to delete the county debt commission in the Lieutenant Governor's responsibilities, repeal KRS 66.300 creating the county debt commission.

HB 48 - AMENDMENTS


     HCS - Amend KRS 11.400 to remove the Lieutenant Governor from Count Debt Commission; amend KRS 66.310 to require the state local debt officer to conform to requirements of KRS Chapter 13B; establish requirements for hearings on local indebtedness; establish criteria for denial of bond issue; abolish procedure of appeal to State Debt Commission and establish procedures for appeals to Circuit Court; amend KRS 66.990; and repeal KRS 66.300.

     HCA (1/Title, S. Riggs) - Amend the title to read as follows: "AN ACT relating to agencies dealing with public indebtedness."

     HFA (1, C. Geveden) - Amend House Bill 48/HCS to remove county attorney from the appeals process for county indebtedness.

     HFA (2, S. Riggs) - Amend House Bill 48/HCS to remove the county attorney from the appeals process for county indebtedness.
