HB 528 (BR 1934) - M. Treesh, F. Rasche

     AN ACT relating to the Education Professional Standards Board.
     Amend KRS 161.017 to permit the executive director of the Education Professional Standards Board to have access to papers, books, and records of education personnel and subpoena authority for witnesses as part of an inquiry or investigation relating to disciplinary actions against a certified employee; amend KRS 161.028 to exempt a professional educator who serves on an assessment validation panel or as a test scorer or proctor from KRS 45A.690 or KRS 45A.725 if he or she receives less than $1,000 in a fiscal year; make technical changes.

HB 528 - AMENDMENTS


     HFA (1/P, J. Jenkins) - Add a new section to KRS 161.120 to prohibit the Education Professional Standards Board from taking any disciplinary action relating to actions of a certified teacher while the matter is under review by a court, tribunal, or arbitrator; prohibit any disciplinary actions being taken by the board if the court, tribunal, or arbitrator determines the certified employee should not be disciplined; provide that no other factual finding or legal conclusion made by a school superintendent, administrative body, or arbitrator shall be conclusive in any administrative proceeding conducted by the Education Professional Standards Board.

     HFA (2, R. Nelson) - Amend KRS 12.020, 12.023, and 161.017 to move the administration of the Education Professional Standards Board to the Kentucky Department of Education; modify duties of the board and authority of the executive director; provide oversight and approval of certain responsibilities by the commissioner of education.
