AN ACT relating to prescription drugs in the Medicaid program.
     Amend KRS 205.5631 to delete the definitions for "availability" and "new drug"; amend KRS 205.5634 to require the Department for Medicaid Services to consider the therapeutic effectiveness and cost in placing drugs on the prior authorization drug file; amend KRS 205.5638 to require the Drug Management Review Advisory Board to make recommendations to the commissioner regarding placement of drugs on the nonprior authorization list, and require review of each new drug within 60 days following the date the drug became eligible for coverage by the Medicaid program; and repeal KRS 205.5632, which requires new drugs to be on the Medicaid nonprior authorization list for twelve (12) months and requires any drug of the same pharmacological category with a comparable clinical application, efficacy, safety, and cost to also be placed on the nonprior authorization drug file.
