HB 656 (BR 2035) - R. Webb, J. Gray

     AN ACT relating to workers' compensation.
     Amend KRS 342.690, relating to workers' compensation, to delete an employer's exemption from liability in a case where injury or death is proximately caused by the employer's failure to comply with a specific statute or administrative regulation, if the employer has previously violated such statute or administrative regulation.

HB 656 - AMENDMENTS


     HFA (1, J. Turner) - Amend KRS 342.690 to provide that is an employer knowingly violates a safety or health law, standard, or administrative regulation, and an employee is injured or dies as a result, the employer shall not be exempt under this section.

     HFA (2, S. Nunn) - Amend KRS 342.690 to prohibit the exemption from liability under this section from applying in cases where an employee injury or death occurs as a result of an employer's willful or intentional violation of federal or state occupational safety and health standards, or where the Secretary of the Labor Cabinet or his designee determines that the employer has exhibited a pattern of violations that are the result of willful or intentional disregard for occupational safety and health standards; require the commissioner or courts, when determining liability, to consider whether or not the employee was negligent or willfully or intentionally disregarded federal or state occupational safety and health standards.
