HB 658/Analysis (BR 1455) - J. Richards, G. Stumbo, J. Barrows, J. Callahan, L. Clark, H. Moberly
      AN ACT making appropriations for the operations, maintenance, support, and functioning of the judicial branch of the government of the Commonwealth of Kentucky and its various officers, boards, commissions, subdivisions, and other state supported activities.
     	The Judicial Branch Budget Bill; appropriate in the Court of Justice moneys form the general fund, restricted funds, and federal funds totaling $233,645,300 in fiscal year 2002-2003 and $274,168,100  in fiscal year 2003-2004; provide a 5% salary adjustment in fiscal year 2002-2003 and fiscal year 2003-2004 for non-elected court personnel and justices and judges; include funds for the salaries of circuit clerks in fiscal year 2002-2003 and fiscal year 2003-2004 as recommended in the judicial branch budget recommendation; provide for the 2001 actuarial assessed need for the Judicial Form Retirement System; provide for the following local facility projects: a. HB 658 - AMENDMENTS 
      HFA (1, H. Moberly) - Make technical corrections to the Judicial Branch Budget and include language relating to the Kentucky Legal Education Opportunities (KLEO) program. 
       HFA (2, B. Yonts) - Provides that courthouses authorized by the 2000 General Assembly will be funded regardless of changes to the Judicial Branch Budget. 
       HFA (3, J. Barrows) - Provide that nothing in HB 658 shall reduce the funding for court facility projects. 
       SCS/Analysis - Increase general fund appropriations for court operations and administration in fiscal year 2003-2004 by $750,000; increase the general fund appropriations for the local facilities fund by $250,000 in fiscal year 2003-2004; provide that to the extent that facilities authorized by the 2000 General Assembly do not become operational as anticipated, the Judicial Branch is authorized to utilize up to $701,800 in fiscal year 2002-2003 and up to $620,600 in fiscal year 2003-2004 for the purpose of supporting expenditures relating to agencies and programs with the Administrative Office of the Court; notwithstanding the provisions of KRS 30A.200(4), in addition to providing for the provisions in accordance with KRS 30A.200(4), the fees deposited for this purpose shall also be used to provide funds to support the costs associated with establishing a Deputy Clerk Career Ladder, contingent upon passage of 2002 HB 452 or other enabling legislation.
