HB 668 (BR 2224) - R. Palumbo, L. Clark

     AN ACT relating to private fire and explosion investigators.
     Create a Board of Licensure for Private Fire and Explosion Investigators and establish licensure requirements.

HB 668 - AMENDMENTS


     HCS - Retain original provisions except place board within the Office of the State Fire Marshal; increase board membership from 7 to 9 members; specify that those board members who are not governmental employees be paid a $100 per diem; establish a separate agency fund to be used for the expenses of administering this chapter; expand the department's authority to include the power to enter upon the premises of a fire scene and require any person on such premises to present proof of his or her licensure; authorize the department to enjoin violators; require city, county, and Commonwealth's attorneys to represent the department, its officers, agents, and inspectors in enforcing this chapter; require that each employee of a company that engages in fire and explosion investigating shall be licensed.

     HFA (1, R. Palumbo) - Amend to limit the practice of private fire and explosion investigators to determining the cause or responsibility for fires, explosions, losses, accidents, or injuries to persons or property, and matters related thereto; require the holding of a license to practice private fire and explosion investigating; and delete certain occupations form those exempted from the application of the chapter.

     HFA (2, R. Palumbo) - Amend to limit the practice of private fire and explosion investigators to determining the cause or responsibility for fires and explosions; require the holding of a license in order to practice private fire and explosion investigating; and delete certain occupations from those exempted from the application of the chapter.

     HFA (3, R. Palumbo) - Retain all provisions, and exempt from licensure investigators determining the cause of a fire that does not require an insurance agent or company's employee; require investigators at a fire scene on behalf of an insurance company to be licensed.

     HFA (4, R. Palumbo) - Exempt from provisions of bill an insurance company, agent, or adjuster if he or she is licensed under KRS Chapter 304 and his or her investigative duties are limited strictly to matters pertaining to an insurance transaction; prohibit an independent adjuster or investigator not licensed under KRS Chapter 304 to investigate the cause and origin of fire or explosion to be licensed under this bill.

     HFA (5, R. Palumbo) - Exempt from provisions of bill an insurance company, agent, or adjuster if he or she is licensed under KRS Chapter 304 and his or her investigative duties are limited strictly to matters pertaining to an insurance transaction; prohibit an independent adjuster or investigator not licensed under KRS Chapter 304 to investigate the cause and origin of fire or explosion to be licensed under this bill.

     SCA (1, B. Guthrie) - Remove ", infer, or" from the provision prohibiting any person who is not licensed as a private fire and explosion investigator from using any of the terms, titles, or abbreviations that express, infer, or imply that the person is licensed as such.

     SFA (2, E. Worley) - Amend HB 668/GA to change the composition of the Board of Licensure for Private Fire and Explosion Investigators by adding a member of the faculty of the Fire and Safety Engineering Technology Program at Eastern Kentucky University who teaches fire, arson, and explosion investigating, and reducing the number of fire and explosion investigators on the board from four (4) to three (3).

     SFA (3, E. Worley) - Amend HB 668/GA to exempt applicants who hold a baccalaureate or masters degree in fire, arson, or explosion investigation conferred by Eastern Kentucky University or equivalent program, certification as a fire and explosion investigator from the National Association of Fire Investigators, or certification as a fire investigator from the Bureau of Alcohol, Tobacco and Firearms from any education, training, and examination requirements set forth in the chapter or established by the board.
