AN ACT relating to death certificates.
Create a new section of KRS Chapter 213 to require that a physician or coroner preparing a death certificate to have it notarized; provide that a notarized death certificate is prima facie evidence of death for all legal purposes; provide that an amendment to a notarized death certificate can be made following receipt of autopsy results as to cause of death; amend KRS 72.465 relating to the coroner or physician signing a death certificate, to add notarization; amend KRS 213.011 relating to vital statistics definitions to delete reference to provisional and interim death certificate and insert notarization; amend KRS 213.076 relating to a certificate of death and provisional certificate of death to replace both with notarized certificate of death; amend KRS 213.091 relating to a delayed death certificate to add provision for notarization; amend KRS 213.146 relating to maintenance of records relating to vital statistics to insert notarization with regard to death certificates; amend KRS 391.300 relating to definitions for payable-on-death accounts to include notarization of death certificates; amend 397.1005 relating to evidence of death or status to provide for notarization of death certificate.
HB 701 - AMENDMENTS
HCS - Delete provisions of bill; amend KRS 213.076 to provide that, if a cause of death is unknown or pending investigation, the death certificate may be filed with an “unknown” or “pending investigation” notation on the cause of death; provide that results of pending tests or investigation shall be filed at a later time with the Department for Public Health with a supplemental report.
