HB 733 (BR 2414) - B. Heleringer, K. Stein

     AN ACT proposing an amendment to the Constitution of Kentucky relating to powers of the General Assembly.
     Propose to create a new section of the Kentucky Constitution authorizing the General Assembly to establish certain oversight committees, the powers and duties of which will be prescribed by law, including the right to approve, reject, or amend contracts, bond proposals, or other agreements the Commonwealth is a party to, whether or not the General Assembly is in session.

HB 733 - AMENDMENTS


     HCS - Delete existing provisions except for submission to voters; propose to create new section of the Kentucky Constitution to authorize the General Assembly to, through its administrative regulations review process and procedures, find an administrative regulation deficient, at which time the regulation shall not become effective until fifteen days after the adjournment of the next regular session, unless the General Assembly acts in the next regular session after the finding of the deficiency.

     HFA (1, B. Heleringer) - Amend to permit the General Assembly to establish certain oversight committees, the powers and duties of which will be prescribed by law, including the right to approve, reject, or amend contracts, bond proposals, or other agreements to which the Commonwealth is a party, whether or not the General Assembly is in session.

     HFA (2, G. Lindsay) - Provide that a deficient administrative regulation does not become effective unless approved by the General Assembly.

     SCS - Propose an amendment to create a new section 36a of the Kentucky Constitution to provide that if an administrative regulation is found deficient according to a review process established by the General Assembly, it shall not become effective unless the General Assembly votes to approve the regulation during its next regular session following the finding of deficiency; provide for submission to the voters; include the ballot language.
