HB 763 (BR 2511) - S. Westrom, P. Clark, D. Horlander
AN ACT relating to training for caregivers of long-term care.
Create a new section of KRS Chapter 216B to require, as a condition of licensure, that long-term care facilities provide specialized dementia-care training for employees; require each facility employee to receive basic written and verbal information about interacting with persons with Alzheimer's disease or a related disorder at time of initial employment or within 1 month after effective date of Act; require employees with direct contact with residents with Alzheimer's or a related disorder to have initial training that includes an overview of dementia and basic skills in communicating with a person with dementia; require employees who provide direct care to complete annual continuing education; require training to be approved by the Alzheimer's Disease and Related Disorders Advisory Council; require the Office of Alzheimer's Disease and Related Disorders to maintain a list of approved Alzheimer's and dementia training resources; provide that the training provided to certified nursing assistants, nurses, or other health professionals to be included as part of the total number of hours required for annual training for those professionals; require that employee be given a certificate of completion for the training; and require the facilities to designate a person who will be responsible for the staff training programs.
HB 763 - AMENDMENTS
HCS - Delete original proceedings; create a new section of KRS Chapter 216B to require a long-term care facility as defined by KRS 216.535, except for personal care homes, that advertises that it provides special care for persons with a medical diagnosis of Alzheimer's or that maintains an identifiable unit for the treatment of Alzheimer's to provide 8 hours of orientation training and 5 hours of annual continuing education to all staff members in the care and handling of Alzheimer's disease or related disorders, and specify certain areas that the orientation should cover.
SFA (1, J. Denton) - Create a new section of KRS 205.510 to 205.645 to require adult day health care programs to provide services only during the posted hours of operation.

SFA (3, J. Denton) - Create a new section of KRS Chapter 436 to provide that nothing in Section 1 of 2002 House Bill 138/GA shall be construed to restrict areas of scientific research or treatment not specifically prohibited by federal regulation, including research in the use of nuclear transfer or other cloning techniques to produce molecules, DNA, cells other than human embryos, tissues, organs, plants, or animals other than humans.
SFA (4, J. Denton) - Create a new section of KRS Chapter 436 to provide that a person who violates the provisions of Section 1 of 2002 House Bill 138/GA for pecuniary gain shall be civilly liable in an amount not less than $50,000 and not greater than double the amount equal to gross gain, if that amount is greater than $50,000.
