HB 77/LM (BR 975) - B. Yonts

     AN ACT relating to autopsy reports, photographs, and associated records.
     Create a new section of KRS Chapter 72 to limit distribution of autopsy reports to specified persons and agencies; amend KRS 72.992 to provide penalty.

HB 77 - AMENDMENTS


     HCS/LM - Create a new section of KRS Chapter 72 prohibiting public access to autopsy photographs and video recordings, providing exemptions therefor, and providing procedure to petition the court for access thereto; amend KRS 72.992 to provide civil penalties for violation; and express that the Act is not meant to alter any existing law with respect to availability of autopsy records not otherwise provided for.

     HFA (1, B. Yonts) - Conform internal references and clarify a change in HCS.

     HFA (2/Title, B. Yonts) - Amend title to read "AN ACT relating to autopsy photographs, audio recordings, and video recordings."

     HFA (3, G. Stumbo) - Prohibit the release of an autopsy photo, other visual image in whatever form, video recording, or audio recording under most circumstances; permit limited release for a limited purpose; establish penalties for improper release of an autopsy photo, other visual image in whatever form, video recording, or audio recording; establish penalties for an individual who receives such materials for a limited purpose and then uses the materials for some other purpose.
