AN ACT relating to electric utilities.
     Amend KRS 278.020 to require the commission when granting a certificate of need to balance the environmental benefits of clean coal technology with the life cycle cost of constructing the plant; permit recovery of up to three percentage points on shareholder equity for plants using clean coal technology if they use Kentucky coal as the principal fuel stock; permit the commission to consider other financial incentives for projects to develop clean coal technology that utilizes Kentucky coal as the primary fuel source; require the commission, when considering gas-fired generation to determine whether the additional plant will significantly affect or is part of a trend towards greater reliance on natural gas as a generating fuel; require the commission, in granting a certificate of need for gas-fired generation to consider whether the additional gas-fired capacity will adversely impact the retail price of natural gas for end-users in the Commonwealth.
