AN ACT relating to the transportation of persons for hire.
Create new sections of KRS Chapter 281 to allow a consolidated local government or an urban-county government to be granted authority by the Transportation Cabinet to regulate taxicabs in their own jurisdictions; set forth procedures for submitting a request for the regulatory authority; require the local government to adopt an ordinance regarding regulation of taxicabs and set forth the areas of public comfort, safety, and convenience that must be addressed in the ordinance; require the cabinet to review the ordinance and, if it determines that the ordinance meets the statutory requirements, to grant the requested authority; require all taxicabs operating under a permit issued by a local government or under a certificate issued by the cabinet to undergo an annual safety inspection; require all taxicab operators applying for or renewing a permit or certificate to file proof of having successfully passed a safety inspection; establish procedures for taking a taxicab that fails a safety inspection out of service and procedures for reinstating it when the deficiencies have been corrected; grant the Department of Vehicle Regulation or local government the authority to revoke, or permanently deny, the certificate or permit of any person who willfully and intentionally files a fraudulent safety inspection record for any taxicab; grandfather in existing taxicab certificate holders to operate the number of vehicles they had in effect on the day regulatory authority is shifted.
HB 839 - AMENDMENTS
HCS - Retain original provisions and amend KRS 138.446 to authorize taxicab companies regulated by urban-counties and consolidated local governments to receive a motor fuel tax refund.
HCA (1/Title, S. Riggs) - Amend the title to read as follows: "AN ACT relating to taxicabs."
