AN ACT relating to sewerage collection and treatment.
Create new sections of Subchapter 70 of KRS Chapter 224 to provide that it be unlawful to use or maintain straightpipes, privies, cesspools, and sinkholes for sewage; provide that parties without access to sewers have and maintain approved on-site system; provide that property owners with property on which there is an existing, occupied building and which is accessible to a sewer, connect to it within 90 days; provide for definition of "accessible", provide that proper materials and connection be used; provide for penalties; provide that property owners with property that becomes accessible to sewer connect with sewer in 90 days; provide definition of "accessible"; provide that proper material and connection be used; provide for penalty; provide that property owners with property accessible to a sewer, and on which an occupied building is built, connect to sewer at time of building construction; provide definition of "accessible"; provide that proper material and connection be used; provide for penalty; provide for waiver of service under certain conditions; provide that storm water may not be drained into sewer line; amend KRS 224.99-010 to provide penalties for violation.
HB 854 - AMENDMENTS
HCA (1, I. Branham) - Delete Section 1 findings and replace with similar but non-codified findings inserted as non-codified text above the enacting clause; delete Section 7 amending KRS 224.99.010 penalty provisions; make minor technical corrections in conformity with deletion of Section 7.
HFA (1, J. Gray) - Exempt approved on-site wastewater and sewage disposal systems from the provisions of Section 1; and require sewer connections as prescribed except when an approved on-site wastewater or sewage disposal system is available.
