AN ACT relating to the grape and wine industry.
Create a new section of KRS Chapter 260 to outline the duties of the newly created Kentucky Grape and Wine Council, which include research, provision of information to vendors and producers, and design and implementation of market promotion activities; outline additional duties of the council to advise the Commissioner of Agriculture in the expenditure of funds from the newly created Kentucky grape and wine council fund, the hiring of staff to assist the council, the promulgation of administrative regulations to carry out the duties and recommendations of the council, coordination with the Kentucky Department of Agriculture and other state agencies, and reporting annually to the Governor and the General Assembly; create a new section of KRS Chapter 260 outlining the duties of the Commissioner to receive and disburse funds from the Kentucky grape and wine council fund, to hire staff to assist the council, promulgate administrative regulations to carry out the duties and recommendations of the council, assist in the preparation of the annual report, and monitor the activities of the council to ensure performance of the duties of the council; create a new section of KRS Chapter 260 to create a new fund entitled the "Kentucky grape and wine council fund," restrict disbursement to the Commissioner of Agriculture or his designee, provide that all investment income and unexpended balances shall be reinvested in the fund and not lapse into the general fund, and that the fund shall only be used for the purposes and benefit of the Kentucky Grape and Wine Council; amend KRS 260.165 to delete the "Grape Industry Advisory Committee," and create in its place the Kentucky Grape and Wine Council.
HB 855 - AMENDMENTS
HCS - Retain original provisions of bill, except amend Section 1, subsection 2, by providing that the council shall carry out the added duties of the Act to the extent that funds are available; amend Section 2 to provide that the Commissioner shall carry out his additional duties under the Act to the extent that funds are available; and amend Section 4 to ensure that members are reimbursed from the Kentucky Grape and Wine Council fund for travel expenses incurred while attending meetings.
HFA (1, J. Haydon) - Retain original provisions of bill, except amend Section 4 by increasing the membership on the Kentucky Grape and Wine Council to nine members and specify that three winery operators and two grape producers be appointed by the Governor from a list of ten compiled by the Kentucky Vineyard Society and the council; amend Section 4 by requiring the Governor to make the appointments; make technical changes to Section 4 regarding quorum size and number of members needed to call a meeting.
