HB 89 (BR 1062) - P. Bather

     AN ACT relating to the licensing of drivers.
     Amend KRS 186.450 to require a person under the age of 21 to have an instruction permit 6 months before applying for a transitional license; create a new section of KRS 186.400 to 186.640 to create a transitional driver's license; require the transitional license to be held for 6 months before a person may apply for a full operator's license; establish a $6 fee for a transitional license; allow a person with a transitional license to operate a motor vehicle unsupervised between 6 a.m. and 10 p.m. but if driving between 10 p.m. and 6 a.m. require a person with a transitional license to be supervised by a licensed driver who is at least 21 years of age; limit the number of passengers a person with a transitional license may carry to 2, not to include members of the person's immediate family; prohibit the issuance of a transitional license if the person applying was convicted of any drug, alcohol, seat belt, or other traffic offense while the person held an instruction permit; require a transitional license to be suspended if the person holding it is convicted of any drug, alcohol, seat belt, or other traffic offense; establish a $25 reinstatement fee if the transitional license is suspended; amend KRS 186.412 to require persons applying for an instruction permit to present written proof from their parents that the person has completed a minimum of 50 hours of driving experience; require 10 of the 50 hours to be certified as nighttime driving; amend KRS 186.410, 186.440, 186.470, 186.480, and 186.531 to conform; make the effective date January 1, 2003.
