SB 123 (BR 1734) - L. Saunders
AN ACT relating to the consumption of wine.
Create a new section of KRS Chapter 243 to permit a restaurant to allow its patrons to bring wine onto the premises for consumption with the patron's meal; prohibit a patron from removing unopened wine from the premises; permit the restaurant to charge a fee for uncorking, providing setups for, or serving the wine.
SB 123 - AMENDMENTS
SCS - Retain original provisions; clarify that wine may be brought in only at those premises with a restaurant wine license.
HCS - Retain original provisions except permit a holder of a retail drink license or a retail package license to transport distilled spirits and wine from the premises of a licensed wholesaler to the licensed premises of the retail licensee; require the licensee to transport in a marked vehicle; permit a retail drink licensee to provide samples of distilled spirits and wine on the licensed premises in limited amounts; authorize the issuance of a golf cart supplemental license; allow a caterer licensee to serve distilled spirits and wine at locations for which retail malt beverage licenses have been issued to nonprofit organizations; authorize the issuance of a distilled spirits and wine temporary license or a special temporary wine license to a nonprofit organization holding a retail malt beverage license; require a retail drink licensee to adhere to existing laws concerning giving samples; allow a distiller, brewer, wholesaler, or retailer to donate to a public or private, nonprofit, charitable organization, for the purpose of fundraising events and activities, distilled spirits or wine the license holder possesses under its license to manufacture or sell; allow a distillery to sell souvenir packages at retail to business entities holding events on the distillery premises in the amount of one liter per visitor attending the event; permit the department to require a licensee to submit additional documentation of food and drink sales if the department reasonably believes that the required percentage of food sales is not being met; permit the department to impose training in lieu of suspension and revocation if the department believes the licensee's violations are due to the licensee's lack of knowledge and that training will resolve the problem; add language creating a fifteen minute grace period beyond closing time when distilled spirits and wines and malt beverages sold before closing may be consumed; permit the governing body of any city or county to allow Sunday sales at restaurants, motels, and hotels.
HCA (1/Title, D. Butler) - Amend SB 123/GA to change the title to "AN ACT relating to alcoholic beverages."
HFA (1, J. Vincent) - Prohibit licensees under KRS 242.1292 from having Sunday sales; make the provision permitting a nonprofit organization with a retail malt beverage license to obtain a temporary liquor or wine license for up to 10 days inapplicable to those licensed under KRS 242.1292.
HFA (2, J. Vincent) - Prohibit licensees under KRS 242.1292 from having Sunday sales.
HFA (3, J. Jenkins) - Provide that retail drink licensees may give samples under the same rules retail package licensees operate.
HFA (4, K. Upchurch) - Amend SB 123/HCS to add a new section designating the Act the Thomas J. Burch Self-Intoxication Act of 2002.
HFA (5, T. Riner) - Encourage state-owned facilities to implement policies banning the sale of alcoholic beverages at sporting events that are likely to have children in attendance.
HFA (6, J. Jenkins) - Clarify that the provisions permitting a locality to enact an ordinance permitting Sunday sales will apply notwithstanding other provisions of the Kentucky Revised Statutes.
