SB 184/LM (BR 1966) - T. Buford, A. Kerr, E. Scorsone
AN ACT relating to retirement.
Amend KRS 67A.360, relating to the policemen's and firefighter's retirement fund in an urban-county, to change the definition of "salary"; amend KRS 67A.410 to provide that members retiring after the effective date of these provisions, may retire at 20 years with no age limitation; amend KRS 67A.430 to provide an annual increase to the minimum annuity of $1,000; amend KRS 67A.440 to provide that a surviving widow of a member killed in the line of duty shall receive a retirement allowance even if she remarries; amend KRS 67A.492 to provide that a qualified surviving widow is eligible for benefit regardless of the date the member retired or dies; amend KRS 67A.520 to provide that the board must set an employer contribution rate every two years, that it must not be less than 21.6%, and that it must not be changed during the specified period of time; amend KRS 67A.550 to provide that the board must distribute an annual report to retirees as well as active members; amend KRS 67A.580 to require that a surplus be used to reduce the employee contribution, not the government contribution; amend KRS 67A.620 to require that a retirement benefit not be considered marital property or an economic circumstance in divorce; amend KRS 67A.690 to delete the age reference for an annual increase; create a new section of KRS 67A.360 to 67A.690 to require the police and fire pension fund in an urban-county government to provide retiree health and medical insurance.
SB 184 - AMENDMENTS
SCS/LM - Retain original provisions except amend KRS 67A.360 to provide a vote by the active membership by March 1, 2003, to decide the 20 and out provision rather than mandating it; delete the changes to KRS 67A.492 and 67A.550; delete the change in KRS 67A.520 providing an employer contribution rate of 17% rather than 21%; restore current language that references age requirements for retirement and annual raises; replace proposed language dealing with health insurance coverage with new language that provides insurance to some current and all new city, police, and firefighter retirees, or eligible beneficiaries, and provide an insurance premium on behalf of each qualified retiree that is 100% of the employer contribution for a single plan for current employees; amend KRS 403.190 to exclude urban-county fire and police pensions from definition of marital property.
HCS/LM - Retain original provisions and add language to create new sections of KRS Chapter 281 to allow a consolidated local government or an urban-county government to be granted authority by the Transportation Cabinet to regulate taxicabs in their own jurisdictions; set forth procedures for submitting a request for the regulatory authority; require the local government to adopt an ordinance regarding regulation of taxicabs and set forth the areas of public comfort, safety, and convenience that must be addressed in the ordinance; require the cabinet to review the ordinance and, if it determines that the ordinance meets the statutory requirements, to grant the requested authority; require all taxicabs operating under a permit issued by a local government or under a certificate issued by the cabinet to undergo an annual safety inspection; require all taxicab operators applying for or renewing a permit or certificate to file proof of having successfully passed a safety inspection; establish procedures for taking a taxicab that fails a safety inspection out of service and procedures for reinstating it when the deficiencies have been corrected; grant the Department of Vehicle Regulation or local government the authority to revoke, or permanently deny, the certificate or permit of any person who willfully and intentionally files a fraudulent safety inspection record for any taxicab; grandfather in existing taxicab certificate holders to operate the number of vehicles they had in effect on the day regulatory authority is shifted; amend KRS 138.446 to authorize taxicab companies regulated by urban-counties and consolidated local governments to receive a motor fuel tax refund.
