SB 262 (BR 1360) - R. Stivers

     AN ACT relating to the administration of estates.
     Amend KRS 391.030 and create two new sections of KRS Chapter 394 to allow surviving spouses and surviving children, where there is no surviving spouse, to claim a personal property exemption up to $15,000 from the decedent's estate and make provisions for renunciation as well as a right of contribution.

SB 262 - AMENDMENTS


     HCS - Delete Sections 2 through 4 of the bill; retain Section 1 except restore existing language in subsection (4) relating to application in testate or intestate estates.

     HFA (1, J. Richards) - Amend KRS 395.605 to provide that the court may accept an executed waiver for informal settlement and to provide that a beneficiary has thirty days in which to withdraw his or her waiver and require an accounting of assets and expenditures.

     CCR - Cannot agree.

     FCCR - Adopt the House committee substitute and add a new section amending KRS 395.605, relating to informal settlement of estates, to clarify that the beneficiaries of an estate may request an accounting of the assets of the estate before an informal settlement of the estate.
