SB 31 (BR 48) - R. Roeding, V. Moore, E. Tori

     AN ACT relating to government contracts.
     Create and amend sections of KRS Chapter 45A to express legislative intent relating to review of contracts and memoranda submitted to the Government Contract Review Committee; exempt from routine review memoranda of agreement (MOAs) between state agencies and universities, but require filing of the agreement with the Government Contract Review Committee not more than thirty (30) days after the effective date; require routine review of MOAs filed more than thirty (30) days after the effective date and provide for ongoing jurisdiction and agency participation; prohibit work on MOAs until filed with the committee along with proof of necessity and prohibit payment after committee disapproval; allow for governmental emergencies if a detailed description is filed and allow the committee to object to or disapprove the rationale for the emergency, reviewable only by the Governor; allow the committee to receive testimony under oath and establish procedures; allow multiyear contracts and MOAs that exceed the biennium if funded by federal grant money; redefine terms; delete exemption for nonfinancial agreements; delete reference to price contracts for personal services; expand exemption for artists; remove the provision exempting agreements between state agencies and state universities or colleges from the definition of MOA; require request for proposals for personal service contracts over $10,000; specify that personal service contracts and MOAs shall not be paid until after completion of the review process by the committee; specify that, in the event of a governmental emergency, the secretary of the Finance and Administration Cabinet and the agency head must make a determination that there is a governmental emergency, communicate those reasons to the committee and allow disapproval or objections; delete requirement for annual reports; amend KRS 154A.120 to conform; repeal KRS 45A.023, relating to multiyear federal grant project agreements.

SB 31 - AMENDMENTS


     SFA (1, R. Roeding) - Require the Governor to make a decision within five (5) days in case of objection by the committee to executive branch emergency declarations; define multi-agreements; and make technical corrections.
