SB 66 (BR 358) - K. Stine, R. Roeding, J. Westwood

     AN ACT relating to the merger of Chapter 75 volunteer fire districts.
     Amend KRS 75.020 to provide a merger incentive to qualified volunteer fire districts created under the provisions of KRS Chapter 75 to receive all fire departments' volunteer aid funds for the first 3 years after merger, half of the amount in years 4 through 6 and then a yearly merger incentive of $4,000 thereafter; amend KRS 95A.262 to conform.

SB 66 - AMENDMENTS


     SCS - Delete provisions of original bill and create a new section of KRS Chapter 95A to provide that if two or more volunteer fire departments merge, on years 1 through 3, the merged volunteer fire department receives a sum equal the number of the shares of the volunteer fire department aid as volunteer fire departments that merged, on years 4 through 6 that sum will be reduced by half and a merger incentive of $4,000 will be paid and on year 7 and thereafter, the merged fire department will receive 1 share of the volunteer fire department aid and the merger incentive of $4,000 will continue; provide that the volunteer fire department notify the Commission of the merger; provide that the Commission shall pay "back-payments” to any volunteer fire departments that merged after January 1, 2000, but before the effective date of this act, that the payments shall be disbursed as quickly as fiscally responsible, and that the payments will not affect the other obligations of the fund; provide that if a new volunteer fire department is created out of territory served by a merged fire department, then the $4,000 merger incentive is lost, and the volunteer fire departments revert to only one share of the volunteer fire aid; provide that if the resulting merged volunteer fire department becomes unqualified to receive the volunteer fire department aid for more than 6 months, the merged department shall revert to only receiving one share of the volunteer fire department aid, and shall lose the $4,000 merger incentive; amend KRS 95A.262 to accept the language of Section 1; amend KRS 75.020 to accept the language of Section 1.

     SCA (1/Title, A. Robinson) - Make title amendment.

     SFA (2, C. Borders) - Amend Section 1 of the bill to stop payment of the $4,000 merger incentive to merged volunteer fire departments on year 8 after the merger, and thereafter.

     HCS - Delete provisions of original bill and create new section of KRS 95A establishing procedures for merger of two (2) or more volunteer fire departments; create new section of KRS 95A defining qualified fire department and qualified share; create new section of KRS 95A establishing merger incentives; create new section of KRS 95A requiring volunteer fire departments to notify the Fire Commission of mergers and splits; create new section of KRS 95A establishing requirements concerning split fire departments; create new section of KRS 95A to establish criteria for State Fire Commission to disburse insufficient funds; create new section of KRS 95A establishing requirement that newly merged fire departments remain qualified to receive volunteer department aid and establish deadlines for compliance; and amend KRS 95A.262 to incorporate merged volunteer fire departments within the aid program.
