AN ACT relating to the practice of occupational therapy.
Amend various sections of KRS Chapter 319A to include "licensure" in title of occupational therapy board; redefines occupational therapy to include the practice of and services provided by the profession; require supervision of unlicensed aides; change representation on board; change "certification" to "licensure" for therapists and therapy assistants; provide for annual election of board leadership; identify Franklin Circuit Court as location for injunctions; clarify board's duty to see injunctions; clarify licensing requirements; require training and instruction requirements to be promulgated by administrative regulations; include computer-based examinations; remove statutory reference to preclude "grandfathering" licensees; repeal KRS 319A.130; require evidence of competence for licensure renewal; provide for inactive license status; require fees to be promulgated by administrative regulations; increase fine for violation of statute.
SB 68 - AMENDMENTS
SCS - Retain original provisions except clarify that administrative regulations promulgated by the boards relating to supervision apply only to aides, assistants and unlicensed personnel delivering occupational therapy services; clarify that prohibition applies to those unlicensed by this chapter; delete from the list of services constituting occupational therapy treatments, accessory joint mobilizations other than those of the upper extremity; specify that occupational therapy does not include independent diagnostic evaluations for the determination of visually-related rehabilitative treatment plans or the testing and prescription of optical, electronic, or assistive technology low vision devices; specify that occupational therapist may only provide low vision or visual therapy services if supervised or if by the prescription of an optometrist or ophthalmologist.
SFA (1, J. Denton) - Include "goal-directed activities" as a means for restoring some types of impaired performance abilities; delete psychological impairments as a focus of intervention; change "components of performance" to "aspects" as they relate to some occupational therapy services; delete the provision that members of the board shall be immune from personal liability based on acts performed in good faith; specify in administrative regulations (1) occupational therapy services that do not include visually related treatment plans related to electronic or assistive technology low vision devices, (2) supervision of services or written evaluation plans from an optometrist, ophthalmologist, or physician, and (3) activities related to vision treatments in collaboration with the Kentucky Board of Optometric Examiners.
