HB 103/LM/AA (BR 491) - R. Nelson
AN ACT relating to insurance.
Create a new section of KRS 18A.225 to 18A.229 to require non-participating employers, beginning July 1, 2004, to pay an adjustment fee to the appropriate retirement system for each of its subject employees; direct the Personnel Cabinet to determine the additional actuarial cost to the state group because of retirees from non-participating agencies using a separate rating of the retirees from non-participating agencies; define adjustment fee, non-participating employer, state group, and subject employee; direct the Kentucky Retirement Systems and the Kentucky Teachers' Retirement System to determine the administrative costs to be incurred under this section and notify the Personnel Cabinet of the amounts; require the Personnel Cabinet to notify each non-participating employer of the adjustment fee; require the Kentucky Retirement Systems and the Kentucky Teachers' Retirement System to deposit the amounts paid by non-participating employers into the insurance subsidy escrow account maintained by each; allow the Kentucky Retirement Systems and the Kentucky Teachers' Retirement System to remove funds to pay their respective administrative costs; require, beginning January 1, 2006, the health insurance premium paid for a retiree from a non-participating employer to include the adjustment fee but not otherwise differ from the premium paid by other state group members; direct the Attorney General to take necessary action to recover funds from non-participating employers who become delinquent in the payment of their adjustment fees; prohibit any retired member or beneficiary from having his or her health insurance coverage reduced or terminated because of any provision of this Act.
HB 103 - AMENDMENTS
HCS/LM/AA - Retain original provisions relating to the Personnel Cabinet determining the cost of unescorted retirees to the state group the reimbursement of the Kentucky Retirement Systems for administrative costs, and the collection of delinquent funds by the Attorney General; delete references to the Kentucky Teachers' Retirement System; rate only unescorted retirees who retire after January 1, 2004, separately; require the Personnel Cabinet, with assistance from the Kentucky Retirement Systems, to determine assessment fee as a percent of payroll to be paid by all employers participating in the County Employees Retirement System; begin collection of the assessment July 1, 2005; use separate premiums for unescorted retirees beginning January 1, 2007, with difference in premium paid from the assessment fees.
HFA (1, R. Nelson) - Require the Department of Education to include funds for local districts' portion of the adjustment fee in the department's biennial budget request.
HFA (2, G. Stumbo) - Amend to exempt community action agencies from paying the adjustment fee required of participants in the County Employees Retirement System.
