HB 115/LM (BR 131) - M. Cherry, C. Belcher, K. Bratcher, R. Damron

     AN ACT relating to electrical workers.
     Establish KRS 227A and create new sections to require to be licensed anyone who considers himself or herself an electrician, electrical contractor, or master electrician; prohibit anyone who is not licensed from engaging in activities usually performed by an electrician, electrical contractor, or master electrician; permit a local licensing program in existence on the effective date of this Act or other local government entity to apply to become the Department of Housing, Buildings and Construction's agent to issue and renew licenses; exempt installations under the exclusive control of electric utilities; exempt maintenance workers or engineers who perform routine maintenance; exempt farmers and homeowners installing or repairing electrical wiring on their own property; exempt retailers installing consumer products purchased at retail establishments; expand duties of the Kentucky Electrical Advisory Committee established in KRS 227.530 to assist the department in administering provisions of this act; establish the duties of the department including the authority to promulgate administrative regulations and to grant licenses by reciprocity to individuals from other states whose credentials are substantially equal to those required in this Act; permit the grand fathering in of individuals currently engaged in the work of an electrician, electrical contractor, or master electrician who can verify appropriate years of experience in their respective areas until July 15, 2004; establish procedures for license renewal and reinstatement for license renewal; set grounds for license revocation; permit an aggrieved party to bring an action against the department in the Circuit Court of Franklin County; establish penalties; amend KRS 227.480 to include that a city or county or state cannot issue a construction permit unless the applicant has proof of licensure in accordance with this Act: repeal KRS 227.490 and 227.4901.

HB 115 - AMENDMENTS


     HCS/LM - Retain major provisions of Act, except to require that an unlicensed person perform electrical work under the direct supervision of a licensed electrician or electrical contractor; require that Sections 1 to 14 of this Act supersede all ordinances and regulations regulating electricians and electrical contractors at the local government level, but shall not affect local government zoning requirements or occupational payroll taxes pertaining to electricians and electrical contractors; prohibit Sections 1 to 14 of this Act from applying to persons performing work for telecommunications companies for which the voltage is 50 volts or less; permit funds for initial administration of this Act, to the extent fee income is insufficient to meet actual costs as determined by the chief budget officer of the Dept., to be borrowed from the surplus trust and agency accounts of the Dept. and repaid, without interest, over succeeding fiscal years.

     HFA (1, M. Cherry) - Retain original provisions of bill except require that nothing in the bill shall apply to the installation, maintenance, or repair of a major medical equipment device.

     HFA (2, M. Cherry) - Retain original provisions of bill except that nothing in the bill shall prohibit a factory-authorized representative from the installation or maintenance of a major medical equipment device provided the installation begins at the load side of the equipment disconnect and is confined to the equipment only.

     HFA (3, M. Cherry) - Retain original provisions of bill except that nothing in the bill shall prohibit a factory-authorized representative from installing, maintaining, or servicing medical equipment devices; prohibit work that provides electrical feeds into power distribution units or work regarding installation of conduits and raceways; allow factory engineers or third-party service companies with equivalent training who are qualified to perform such service; and change master electrician's licensing fee from $200 to $100.

     SCS/LM - Amend KRS 227.530 to include on the Electrical Advisory Committee one member who is engaged in the business of electrical contracting and who employs no more than five full-time employees when appointed.
