HB 118 (BR 383) - T. Burch, T. Riner

     AN ACT relating to the transfer of unused prescription drugs to charitable health care providers.
     Create new sections of KRS Chapter 217 to define "assisted-living community," "charitable health care provider," "hospice care program," "hospital," "legend drug," and "nursing home"; provide for the transfer of unused legend drugs, except for controlled substances, from a hospital, nursing home, assisted-living community, or hospice care program to a charitable health care provider; require agreement between facilities and specify minimum provisions; provide for immunity for entities involved in the transfer of the drugs; provide for immunity for pharmaceutical manufacturer; require drugs to be dispensed by person authorized to dispense the drugs; require the Cabinet for Health Services to promulgate an administrative regulation to carry out the provisions of the Act.
