AN ACT relating to protection of personal privacy.
Amend KRS 413.140 and KRS 454.050 to delete obsolete references to the abolished tort of breach of promise to marry.
HB 166 - AMENDMENTS
HCS - Delete original provisions; create a new section of KRS Chapter 365 to provide definitions; create a new section of KRS Chapter 365 to require a business which disposes of records to delete or destroy personally identifying information; provide that person damaged by failure to destroy information may file a civil action for damages; provide for enjoining violations of the act.
HCA (1/Title, G. Lindsay) - Delete Title and replace with "AN ACT relating to the protection of personal privacy."
HFA (1, J. Vincent) - Amend Section 1 to include limited liability companies among those entities listed under definition for business, to add name, address, telephone number, and e-mail address to the definition of personally identifiable information, to remove exclusion of information in publicly available directories from the definition of records, and to alphabetize definitions; amend Section 2 to remove requirement that businesses take reasonable steps to dispose of personally identifiable information that is no longer to be retained and to provide that when businesses do destroy such records that they do so in a manner to make them unreadable and indecipherable; make technical correction to Section 3.
