HB 224 (BR 1023) - M. Cherry

     AN ACT relating to directors of pupil personnel in local school districts.
     Amend KRS 159.140 to delete the requirement that a director of pupil personnel in a local school district devote his or her entire time to the duties of the office; amend KRS 630.060 to conform.

HB 224 - AMENDMENTS


     HCS - Require the director of pupil personnel to devote his entire time to the duties of his office, except a local school district superintendent may annually request the commissioner of education to waive the requirement if the school district has a student enrollment of less than 2,000 students.

     HFA (1, F. Rasche) - Amend KRS 630.060 to conform.

     SFA (1, J. Turner) - Delete requirement for annual waiver; delete district enrollment criteria; and permit the commissioner of education to rescind a waiver if he or she determines that the district needs a full-time director of pupil personnel.

     SFA (2, R. Palmer II) - Amend KRS 158.070 to require that time added to the length of the school day due to weather, illness, or other emergency be calculated as equivalent time to be applied toward the required 175 instructional days for certified personnel.

     SFA (3/Title, R. Palmer II) - Make title amendment.

     SFA (4, R. Palmer II) - Amend KRS 158.070 to provide that when a local school district or school lengthens its school days for students to make up instructional time missed because of weather, illness, or other emergency, the time for certified staff shall be calculated as equivalent time to be applied toward the 175 required instructional days but shall not affect a person's service credit for retirement purposes; if the district uses the flexibility provided under this provision for noncertified personnel, the calculation shall not affect the noncertified person's retirement; EMERGENCY.

     SFA (5, V. McGaha) - Provide that time added to a school day by a school district or school during the 2002-2003 school year to make up school closures be calculated as equivalent time for both students instructional days and teachers and classified staff days; require the equivalent time to be calculated as equivalent time to be applied toward retirement service credit under KRS 161.500 for certified staff and KRS 78.615 for classified staff; EMERGENCY.

     SFA (6/Title, V. McGaha) - Make title amendment.

     SFA (7, D. Williams) - Permit the local district superintendent to waive the requirement that a director of pupil personnel serve full time in his or her position and report the decision to the commissioner of education; delete the requirement that a district have 2000 or less students to have a waiver.
